My Wife registered FIR against me in Faridabad

Hi Shonee Kapoor, 

Thanks for your valuable guidence.

I would like add some more update regarding my case. We have just appeared on 498a case, Our laywer said charges has been set on you and we got date after eight months. My wife did not appeared again. I asked my lawyer that why she is not coming, he said she will not appear untill court send summons to her for "Gawahi" , which will happen on next date, means after eight months. If court will send sunmons then she will apper on 498a case, otherwise might be she will not appear on next date also.

Hello, 

I would like to update my case info. I am going attending court dated for maintainance case, but my wife is not appearing. this is happeneing from last 2-3 dates. today was also the maintainece case date. again she did not appeared in the session court faridabad. Her laywer came to me and said if she will not come in next date, you will get divorce. 

I dont know what is happening! please guide

Ask the court to close her evidence and dismiss the case.

I believe that police is not justified to press for transfer of property in the name of wife simply because they have got a complaint from her. They could insist onreturn of dowry of stridhan but asking for property transfer (not part of dowry) amounts to extortion.  You may perhaps contact Haryana Vigilance Burea and consider feasibility of lodging criminal case against such policeman. Such action may strengthen you allegation of extrotion which is apparent in this case and others experts have also well advised you to cultivae evidence fot the same.

Let her not respond to the case you filed and let her be in the thought that she has erected a fort by filing case in FDB. You get a chance fo ex-parte divorce which may not be so easy if she comes to the civil court and repeat the allegations here also.
