Share certificate for parking slot in co op hsg soc mumbai

Builder sold Mechanical Parking Slot with flat and mentioned in Sale Agreement. Stamp Duty was also paid to Registration Authority on the Parking Slot indicating area of Parking as 150 sq.ft. Now Co Op Hsg Society is registered. Is it Mandatory to get Separate Share Certificate from Society for Parking Slot as per MCS,Model Bylaws and or Maha RERA Rules in Mumbai Suburban.

The registered sale deed selling the parking space is a substantial document to claim the title for the parking space sold to you.

The society will record this.

As per MahaRERA Circular No. 36/2021, only garage spaces (fully enclosed with walls on all sides) can be sold independently. Open, stilt, or mechanical parking slots are not considered saleable units under the Maharashtra Ownership Flats Act (MOFA). So, even if stamp duty was paid and the area was mentioned, it doesn’t override the regulatory stance that such parking is not a separate immovable property.
