Maintenance under dv act

Can a wife, aggrieved by the interim maintenance order by Principal Judge (as bacause the hon'ble judge did't consider the gross income of the husband, rather consider the income he show)? She also filed review but he rejected.

Application under 125 CrPC is towards final and it is on husband cross. It will take a long time to be finalised. 

It has been 2 years that husband took dates on one pretext or another.

Now, Can she contest in DV act for interim maintenance? She has to live as per the status of the husband. But the Hon'ble MM dealing with DV Act refuse to hear any more on the basis that interim has been awarded in another court.

What should she do to take the interim maintenance as per her status.  Is there any judgement stating that wife can also argue in DV Act.

Wife can argue in ten different courts under ten different sections of law, but she will be awarded relief of maintenance under only one section and not all the sections under which she has asked for.  There is a judgement which you may find attached for your use.
