Legal heirship certificate

What is the process to get a legal heirship certificate in Coimbatore Tamilnadu. Where can this certificate be got. What are the documents to be submitted. Where should these documents be submitted. What are the documents to be attached. Mother expired a year ago leaving a small house She had 8 children and one has expired. What is the process to sell the house and distribute the proceeds to the children.

  • A legal heir certificate is issued by the government for those individuals whose parent/husband is dead without leaving a will.
  • To establish relationship for claims relating to Insurance, pension, retirement benefits or service benefits of central and state government departments, Government undertakings etc.
  • In legal succession cases to get succession certificate to establish the relationship
  • To get employments for example compassionate appointments.
  • Approach the District Thasildar office with the death certificate and produce the form.
  • All required documents to be submit while lodging the application.
  • It will take around a month to process all the necessary information and receive the certificate.

    Required Information

  • Name of the applicant
  • Father / Husband's Name
  • Sex
  • Name of the Deceased
  • Death certificate Number
  • Details of Family Members (Legal Heirs of the deceased)
  • Purpose for which the certificate is required
  • Ration card Number
  • Relationship of the petitioner with the deceased
  • Prescribed application form

O/o Tehsildar issues it, after inquiries by revenue officials.

Deat certificate of mother (owner) and her one child would be required.

Apparently it is simple case of inheritance, as per personal law that applies in this case.

Approach the authrotiy under whose jurisdiction property falls e.g; MC.

Usually the authority keeps forms/procedure for such matters: Intestate Succession on its website and can be obtained from O/o Authority.

Death certificate, legal heir certificates are requirements.

Mutation record is updated by authority and can be obtained with all link documents.

It shall show share of each legal heir.

All legal heir can jointly sign and sell.
