A person took vehicle loan from a Bank and paid all the istallments through cheque .One day he received a summon from the Court u/s 138 of NI Act .He was surprised a lot . Can a criminal complaint be filed against the bank under which sections . The bank has filed 2 complaint against him. Because of this he has to suffer a lot and his goodwill has also been effected. Even after bringing the facts to the notice of the bank the official did not witdraw the complaint though they had promissed.

It is better you file a quash petition under section 482 Cr.P.C. before the high court by submiting all the relevant documents pertaining to the fulfillment of the loan installments and confirming your non existence of the liability towards the bank as on today.
