DTCP approval

Dear,

I am planning to purchase a plot near to hosur. Plot is having only bagalur panchayat approval but not DTCP approval.

The seller told to me that they have applied for DTCP approval. Is it possible to take approval after selling plots.

Can anybody (from bangalore or hosur) help to verify the documents . Please provide the contact number so that I can contact directly.

Dear Mr.Naveen, What you are trying to buy is a plot in an unapproved layout. Panchayat does not have power to approve layout, only DTCP has got the power. There is no approval called as Panchayat approval, it is an euphemism for unapproved layout. Panchayat can only approve and give permission for construction of building on a plot approved by DTCP or an unapproved layout.

Dear All,

I am also looking at a project near Bagalur which is not DTCP approved. Are there any issues in investing in a layout that falls under the Panchayat? The site layout seems to have some approval from the President, Grade I Panchayat. It this right / true?

What are the repurcussions of buying a site that is not approved by DTCP, but comes under the Panchayat?

Any inputs on this will be very valuable. I sincerely look forward to this.

Hi, I have also tried to do some research and have found the following information. If you are referring to Layouts such as NBR Valley and Ziva Venture (Avanthi Vista) near Bagalur, they are only have Panchayat Approval. Refer to the article from Hindu, whcih clearly states that there is nothing called "Panchayat Approval" [https://www.hindu.com/pp/2006/12/17/stories/2006121700100300.htm].

Also, recently there were press releases on unapproved layouts in Hosur. The recent one is [https://www.thehindu.com/todays-paper/tp-national/tp-tamilnadu/article1449727.ece] where HNTDA [Hosur New Town Development Authority] has given notices to layouts which have Panchayat President's approval, but still are under the purview of HNTDA.

Please make sure that they have the relevant conversion documentations and approval documents from HNTDA.

Even I had the same doubt when i was looking in to a project called NBR Meadows,When it come to the developers reliability they are very geniun,tranparent.Their title are very authentic,according to my Lawyers advice Mr.Subramania who is a High Court Lawyer,when there is a residential area or a village in a redius of 300 mtrs the land has no risk of acqusition more over except the land loan Banks do provide a construction Loans for this land,We were a group of people from IBM and my friends from Oracle have gone for a bulk booking in 2010,Now i had a visit of NBR Green Valley on Bagalur Road which seems like a Hot property.Naven, the developer is very good in aspects of development of the project amenities,documentation,customer satisfaction.They are very tranparent.Thanks for for takeing my words Thank you! all the best for your investment

I dont know about Ziva Avanthi vista but  i had a visit of NBR Green Valley on Bagalur Road which seems like a Hot property.Naven, the developer is very good in aspects of development of the project amenities,documentation,customer satisfaction.They are very tranparent.Thanks for for takeing my words Thank you! all the best for your investment.

Dear MR.Naveen, i am a very old customer of NBR developers.i bought 2 plots with NBR developers.1st @ nbr homes & 2nd @ nbr grren valley.this builder is very clear in documentation,legal,development.i fell whatever NBR developers has promised to developed in their sites they have developed till date. at the time of purchasing the sites i also consulted lawyer for the legal opinion towards the property.the lawyer give me a grren signal but that point of time i was having doubts that witout approval how can we go ahead with the plot.lawyer told me very clearly that in hosur suddenly government has seen enomrous growth & with that they have formed HNTDA{town planning autorities} i feel no body can match NBr developers apperciation,development, n& taes in hosur.

I have bought a plot and constructed the house in the unapproved layout in Bagalur road in 2006 and also availed LIC housing finance loan.  Only after seeing the article in the newspaper only, i came to know that our builder has to apply for the HNTDA approval.  When we approached him, he told us that he won't apply for the DTCP or HNTDA approval and he has got the panchayat approval.  When we approached the panchayt president, he also told us that we don't have to get the HNTDA or DTCP approval and only panchayat approval is sufficient.  Is my property is in any illegal status now.   What action can i take.  Kindly advice.  Is there are any chances that HNTDA will send notice or take action against us.  We don't even have patta for our house.

HI,

From my organization around 5 of us booked sites in AVS Villas which is there on Bagalur Road. AVS is claiming that it is DTCP and HNTDA approved. Also LIC, HDFC, ICICI from Hosur are offering loans for these sites. They also shared the provisional registeration number of DTCP 27/2008. Could you please any one of confirm us that there is no dispute in this layout.

We have also booked a plot with NBR Developers in Golden Valley. They have panchyat approval. Can anybody tell me if it is safe to go ahead and buy the plot? What documents should I ask for?

It seems that it is the responsibility of the “local body” to whom builder shall apply, to forward the application to DTCP. “Local body” is the final authority to give permission. Question: What is the meaning of “local body”? As per Appendix-3, “local body” may mean Panchyat.

The builder shall not directly apply to DTCP; but shall apply only to panchayat.

Only panchayat (local body) shall give approval to the builder.

 

The Tamil Nadu Panchayats Building Rules, 1997 (see

) says “Executive Authority” (which means the President of the Village Panchayat) shall get prior concurrence from DTCP.

The above also gives an format of the application form through which the builder shall apply to the Executive Authority of Village Panchayat.

 

So, it is the responsibility of the Panchayat to get the approval from DTCP. In case, it does not do, Panchayat is answerable to DTCP.

... a correction to my previous message today....I mentioned "As per Appendix-3,", which is to be replaced by https://www.tn.gov.in/dtp/gopdf/3_4.pdf ;

In case you find that the layout is approved by Panchayat, but not approved by DTCP, legally speaking "local body" i.e. Panchayat is responsible. But, we have seen from the following news that Hosur New Town Development Authority (HNTDA) has issued notices to as many as 14 unapproved layouts in and around Hosur.

What shall be the ultimate damage to the site owners is not yet know. I have not heard about any case where Govt. has demolished such unapproved sites.
