Doubts on partition and gift deed

     Hi this is Krishna (age 32) and very week and confuse about partition and its law. My elder brother wanted partition of whole property. I am desperately looking for your help and guidance about this matter.

    Our entire properties belongs to my grandpa when he passed away it went my father and my grandpa’s youngest brother (My father’s uncle). They become 50 – 50 owner for this properties.

     I am not sure in which condition, 50% of property went to my grandpa’s youngest brother (My father’s uncle).

 

Any how He doesn’t have any children, my father and he wanted to gift us (myself and my elder brother) this property 50 – 50.

 

Valuation is done for this property. It comes around 10 Lakh each of us (myself and my elder brother).

 

On the above said scenario and valuation, I have few below doubts which are not clear to me:

 

1)       What is the main difference between Gift deed and transfer (Register) deed

2)       How the process will go ahead. I mean what step we need to follow.

3)       What will be stamp duty and registration charges? (We belongs to West Bengal )

4)       What points I need to take care in the whole process?

5)       Only stamp and registration is enough?

6)       Parents wanted keep 20% free space (common space). Where we both can not construct anything in that premises. What clause we need to take care in this situation?
