Dinakaran's fate sealed by SC collegium

New Delhi, Dec 8 (PTI) The fate of Karnataka High Court Chief Justice P D Dinakaran appears to have been sealed with the Supreme Court Collegium not in a mood to elevate him.



A decision to this effect is understood to have been informally arrived at by the collegium which is likely to meet in the next few days to formally take a decision, highly placed sources said.



"In an informal discussion, the members of the collegium disfavoured Dinakaran's elevation, more so in the wake of the development in the last couple of days," sources told PTI.



Meanwhile, Dinakaran, who was camping in the national capital and met the Chief Justice of India K G Balakrishnan and some judges of the collegium to reiterate his innocence and to refute allegations of land grabbing, left for Banglore this evening.

Elevation part ok. Good. But what abt enquiry about the allegations he is facing?  The decision of the collegium is nothing but beleiving the allegations against him, prima facie.

If a person is not fit for elevation to the supreme court, can he hold office as the chief justice of a High Court? Is it justified?

Certainly not. He ought to resign himself or impeachment motion is to be moved.  Guess some one has moved one.

This is a classic case of Trial by Media and Pronounced Guilty without a Trial.  it has not been made known what is the report submitted by the Collector.  Assuming that a report is available whether the conclusions are backed by any survey and demarcation proceedings?

A curious aspect of the case is that nobody or institution ever made any attempts to actually engage in a constructive and positive identification of the alleged malpractices in a manner known to law.

As known to me the fate of a Judge has been "SEALED" because of the media continuously publishing news articles.  the authors / contributors of the information are a group of advocates.  though the allegations are decade old they curuiously surfaced only now.  this aspect also needs to be looked into.

But why he was not elavated to SC? This clinch the whole episode, was it because SC was scared of the media only? I dont think so.
