Deductions in salary without a prior notification

Hello,

I hail from Navi Mumbai. Upon receiving my last month's salary from my current employer, I was notified that there is a deduction of Rs. 680 towards a bill that has been left unsettled from a guest who came and stayed in the hotel.

Since I am the sales head, I am told now that the deduction was bound to come on me. My question is, whether without a prior notification, can a company hold a deduction in an employee's salary.

When checked with the HR Manager, he told me that the accounts just sent a mail saying there has to be a deduction of Rs. 680 in my salary. What reflects is a salary slip with the deduction under "other deductions" tab.

Sirs, please let me know so that I am in a better position to speak and verify on the above subject.

There can be NO deduction from salary other than statutory deductions like PF, ESIC and others like Life Insurance Premium…………………………..for any other deduction there has to be a private agreement between employer and employee……………….

 

Employer has to maintain proper record of deductions and legitimate deductions are accounted for in

‘Labor Welfare fund’.

 

The standing Orders o the establishment should also be clear on it.

 

You may go thru various enactment s that are applicable to the establishment e.g. Payment of Wages Act 1936: Sec: 3,5,6,7……………………

                                                           

 

Instead of resorting to verbal communications you may submit written representations in writing under proper acknowledgment and a copy to you.

 

 

There is nothing called ‘Other Deductions’ and the deduction has to be explicit and clear.

The so called email should have been sent to you.

 

What is this company/establishment registered as: Commercial, Industrial, Small Enterprise?

 

 

 

It should have displayed its registration Certificate at a conspicuous place e.g near entrance/on notice board!

 

How many employees are employed in it?           

 

What was your designation in offer letter, appointment letter and nature of duties?
