Mvop fraud case filed stating single dependent

My father in law has filed for MVOP for compensation from insurance party for his son's accident. We were divorced a year before my ex's death. I did not take any alimony and maintenance, neither for me or the kid. They are very bad people and I knew they will just keep troubling us. So I left everything with nothing from them. 

Ex passed away 4 yrs back. His friends contacted me regarding filing of compensation case so that the kid who is legal heir and father in law will get it. After thinking a lot on it I agreed to file. Once I sent all docs father in law didn't want to file alongwith kid and he said he will do it seperately. I left this and continued my life. 

Now the kid is 18yrs, all of a sudden father in law and a middle man have started calling me. They are playing games. Telling us that they will give somewhat amount of insurance amount and in return we give back or transfer all the agricultural land to his name. This land belongs to my ex which if I file will be given to legal heir. 

Moreover they say that they have not filed any MVOP case. However, after putting some efforts I see there is a case going on since three yrs. So this proves that he is trying to fool us. He just wants family certificate and to take away everything. 

However, I never even thought of anything from them. I am struggling here by doing two jobs and arranging funds for kid's education and future. 

Please please suggest me what is legal advise on this.

Your son is entitled to a share out of the insurance compensation amount as a legal heir to his deceased father.

Actually speaking your father in law himself is not entitled to a share because he is a class II legal heir and when class I legal heir is available the class II legal heir cannot claim.

Therefore you ascertain the details and take the assistance of an experienced lawyer in the local to proceed legally on the advice of a prudent lawyer.

I sincerely thank you for your advice. 

Father in law has already filed this three years back. In this case how can I proceed to protect the rights of the kid.

Please confirm that whether your son has been impleaded either as a petitioner or as a respondent, if not you may file a petition to get him impleaded and seek for his share specifically in the same case.

The court will certainly allow him as one of the claimants, don't delay further.

You can take the assistance of an advocate in the local to proceed accordingly.

I will get the kid added and will implead in the case. We were not aware of the case. The opposition party tried to tell us some different stories. Thank you for guidance.
