Complainants death

Friends,

The complainant who filed the criminal complaint died two days back. His complaint consists of IPC sections relating to forging documents and hiding facts pertaining to losing money from government exchequer. Based on his complaint chief judicial magistarte had ordered for investigation.  police is being investigating it since 2 years.

Due to his death will this case be closed or not?

The investigation of the case will not stop. The complainant need not be the victim of the offence.

Unless the complainant is the sole witness of the alleged crime, the case can not be closed.

 

The investigative agency would collect all material evidences and submit its report.

 

If the case has no merits thereafter, it can be closed, but not before the same.

Dear All,

It is well settled law anybody can put the Criminal Law into motion. case cannot be closed under any circumstances if there is sufficient evidence for prosecution and police has collected all the evidence under investigation.
