Disconnection of drinking water supply of my flat

Dear Sir,

Our committee had decided to collect extra  amount other than Maintenance for Rs. 45000/- per flat. Out of which i was able to pay Rs. 10000/- and pending is Rs. 35000/-

None of my Maintenance is pending since 5 years.

In perview of the same committee and few members had disconnected our drinking water supply.

Requeat you to guide me for further action and weather it is legal to disconnect.

First you give a police complaint against the trouble makers who causes problems or disturbance to you.

The housing society cannot legally disconnect water supply for non-payment of maintenance dues.

Water is considered an essential service and its disconnection could be seen as a violation of a resident's fundamental rights.

While societies may have bylaws regarding payment and consequences, disconnecting water supply is generally not an acceptable method.

If a society does attempt to disconnect water, residents have legal avenues to contest the action and seek redress.

You may approach court seeking permanent injunction against the society to restrain them from indulging in such activities of depriving you the basic amenities and also to direct them to restore water supply

Lodge police complaint against committee members who have cut your water connection.

It's illegal to disconnect water supply.

Since you are paying maintainainance charges to society regularly so relationship between society and you are as a service provider and consumer society has no authority to disconnect your water connection their such act is legal.you may  file complaint before Consumer Commission and prey for restoration of water connection immediately also claim compensation towards mental and physica agony caused to you .

Have you got a registered association. You can file a complaint against those who claim themselves to be office bearers of the association and get an ex-parte order to open the pipeline to your flat.

Is it a cooperative or some other type of society as referred by you, as rules/ law applicable to them differ ?

Why did you not pay balance of Rs. 35,000/- as demanded by management, presumably all other members of the society has paid ?

File a police complaint as well as a suit for permanent and mandatory injunction before jurisdictional court for stopping water supply since water and electricity are basic requirements and cannot be stopped for non-payment of arrears / dues of maintenance, as advised by learned senior experts hereinabove, which I fully agree and appreciate.
