Query regarding ni act or 420

Hi All, 

One person issued me a cheque and it got bounced. when we are trying to send notice he is escapaing.

Please suggest best alternative on how to take the case foward.

Can we use option1 sure shot ? pls help me on this. 

Option1:- can we approach police station and give a complaint. is it sure police people will log FIR against him ?

opton2:- if we send notice through watsapp , wats the guarantee that he will acknowledge. mostly he will not. how to handle this ?

You first of all send a legal notice to his known address by registered post, let it be returned after that you can either file a cheque bounce case or even lodge a criminal complaint for cheating and breach of trust.

Generally police does not register  complaint of cheque bounce case, complainant have to file complaint before  judicial Magistrate Court

Send notice to accused on his last known address by registered post simultaneously on WhatsApp.

2. File criminal complaint in magistrate court against that person for cheating you.

Have you issued legal notice at the last known address of accused person and it has been returned as "unserved" ?

If so, file complaint u/s 138 of NI Act, 1881 and a (civil) suit for recovery of cheque amount.

Besides this, you can file a complaint before Ilaqua (Area) Magistrate for cheating and fraud committed by the accused.

"when we are trying to send notice he is escapaing." What do you mean by escaping? 

No case of "cheating" lies in the given facts.

Sir,

 

Notices sent by lawyer. But not delivered till now. He changed address.Now pls guide on what to do ?

Even if it's sent on watsapp I doubt if he will open and acknowledge it.
