Consequences of compounding of offence?

In a cheque bouncing case under section 138 NIA, where the cheque amount was Rs. 1,20,000/- the complainant agreed to settle the case by taking Rs. 40,000/- at the pre-trial stage. The accused paid him Rs. 40,000/- in cash in front of the court and the court compounded the offence.

 

The document given by court says that, "Both the parties have volunatirly agreed to settle the case and Mr. X has paid Mr Y Rs. 40,000/-. The case has been comounded......"

 

The questions are:

 

 "Does it mean the accused have been acquitted?"

"Will there be a criminal record of the accused?"

"What effect will the compounding of offence have on the job opportunities in government or private sector for the accused?"


"Can it have a negative effect on foreign travels or for applying for visa in other countries?"


In short how the compounding of offence affect the future of the accused?

Compounding offence means it has been settled between parties.  It is different from acquital. acquital means after full trial court pronounce judgemnt.  There  is no problem for future if the case is compounded.  because complainant has settled with you, than you will not be convicted. So there will no problem for you now to travel abroad.
