Can i challenge deleted questions of a departmental ldce exam for claiming a vacant post???

In a LDCE exam conducted by department of Post, 10 questions out of total 50 questions were deleted as many candidates alleged that those questions were our of syllabus, all the questionsbearing 2 marks each. As a result, the marks of those candidates who wrote correct answers to all of those 10 deleted questions, or 8-9 questions, were drastically reduced while some candidates who wrote most of the answers wrong of those 10 questions got an unfair advantage as their score and percentage increased(I.e someone who scored 84 out of 100 and wrote right answers to all the 10 deleted questions stands at 64 marks out of 80, as his 20 number got deleted and someone who scored 76 out of 100 and wrote only 3 right answers among the 10 deleted questions now stands at 70 marks out of 80 as only his 6 numbers got deleted). As a result, those candidates who were confident of passing the exam with high marks and getting a seat are now in severe depression because their marks has been reduced drastically. My question is if someone fails to clear the cut off due to the fact that he got all the answers correct to the deleted questions and his marks were drastically reduced due to the questions getting deleted, can he challenge that decision and argue for giving him a vacant post as he would have scored very well if those questions weren't deleted???

Get the issue raised by maximum affected candidates before concerned High Court impleading all concerned authorities, through a local prudent lawyer.

Respected Sir, will the court agree with us that our demand is legitimate and order the department to allocate us seats???

The candidates cannot challenge the policy decisions.

If there's a change in the policy then it is applicable in common to all.

You may not get any respite through court even if you plan to approach court for any remedy to this situation.

With all due respect to you sir, but this deletion of question has given some candidates an unfair advantage, as I stated in the question some candidates who have written all the answers or most of the answers correct to these questions have lost as much as 15-20 marks from their score and some candidates who got only 2-3 answers correct or got no answers correct to these questions are not affected significantly as only 4-6 marks have been deducted from their score, isn't it an unfair advantage? Why should meritorious candidates suffer because of these policies of department?

If you are aggrieved by this change of policy decisioin you collect the details that caused you grievance and also the details of the other candidates who were benefited by this sudden change in the policy and seek court's intervention to direct the authorities to provide you the same relief like other candidates.

You may consult an experienced lawyer and file a writ petition before high court for seeking the desired relief, but please ensure that you are one of the victims in this event.

Thank you sir for your kind advice, one more question sir, will court agree with our opinion that some candidates are benefitted from deletion of questions while some candidates are badly affected, and they may direct the department to provide relief to the affected candidates???

T. Kalaiselvan, Advocate (Advocate)     07 April 2025

It is a matter of strong pleadings expressing your grievances and convincing arguments presented by your advocte before court.

The judgment cannot be predicted, we can guide you about the legal process only and cannot render opinion about the verdict of the court.

Yes, you may seek judicial review before the CAT. Deleting questions, as stated, is too whimsical to be labelled a policy decision.

Sudip Sarkar   10 April 2025

Sir, will I have a strong ground in court regarding this matter??? Will Court listen to my arguments that this suddenly deleted questions had given some unfair advantage to many candidates??? Kindly guide me regarding this issue
