C form

we bought a genset of 40 kv from karnataga on 09/01/2013 with cst 2% , but we are not able to give the c form in time. According to the rules ,we applied the sales tax office to issue the c form for the genset .Now the authority says that genset is not inclueded  in your cst registration certificate and so you are not eligibile for issuing c form.

karnataga cst tax is 5.5% without c form ( already we paid 2 % cst in the bill )

Sales Tax says  pay 14.5%  + 1.5 % + penalty  , after that you will get the c form 

genset rate rs 348520 + 2% cst tax 

what is the rule to get c form somebody told if we pay a penallty rs 1000 to sales tax to include the genset in the cst reg. form

please explain

C Form can not be issued. If you issue C Form with false representation then you can be penalised for 1 and 1/2 times of tax saved in issuing the C Form.

If you will filed the application for addition of genset in your cst regsitration w.e.f. 9/1/2013 and the sales tax officer will accepted the same by imposing the minimum penalty than you can issue the C form because you have fulfilled the necessary condition for issue of C form.
