    Dear Sir, I purchased an under construction flat in June 2009. I was supposed to get possession in September 2010 but finally builder is giving possession on December 2011. But before giving possession builder is asking for following: 1. Service tax on the amount I paid after June 2010 (Cash) 2. VAT @ 1% of flat value (Cheque) 3. Society maintenance @ 3 Rs per Sq ft (Cheque) 4. Society formation charge of Rs. 35000 (cash) My question is: 1. Builder is asking for cash for the service tax to be paid and he won't be giving any receipt for the same. Is this ok? 2. For VAT, builder has asked to give cheque in builder name. Why not govt. dept. name? 3. Most importantly builder is asking for Rs. 35000 (cash) as society formation charges and he won't give any receipt also. Is this right? 4. Is this ok to occupy the flat without OC, will there be any legal implication? I would request you to help me with your kind suggestion ASAP for above queries.     I am a law student and I regret to say that level of advocates is decresing day by day. Recently I came to know about an advocate who made some people of his confidence to file a false case against a judge who was not even present on the place of offence to save those people from legal procedings etc. and also complained to high court.I just wnted to enquire that can I complain about such misconduct to bar council and if not then who can and how can one prove such misconduct.     Mr. X has 3 elder brother and 1 younger brother. 1St elder brother got married before 5 years and having 1 daughter and 1 son. 2nd elder brother got married before 4 months. There is always lack of mis understanding or we can say difference in way of thinking between Mr. X's mother and 1st Sister in Law. Due to that there always use to be chaos in the family and as usuall 1st elder brother supports his wife and other 4 brother supports their mother. During the chaos somethimes 1st elder brother started beating his wife. So Mr. X is thinking that in such a way if any accident occurs in the future then he will be involved in the matter unwillingly. So Mr. X is seeking advice from you that if there is any law or regulation in order to get protection.
