  • rakesh says : Famiily law
Dear sir, Iam working on a moot problem which is based on family law. in this particular case the husband and the wife was married according to the provisions of Hindu Marriage Act. Both had frequent fights as the wife was a party animal and used to drink a lot and comes home late such issues were raising between both she even had filed a FIR on the husband and his relatives for mental cruelty but she had withdraw ed it apologizing to the police then the husband filed a divorce petition in family court on the ground of mental cruelty. but the petition was rejected when wife showed interest in the marriage. Meanwhile he came to know that she was pregnant and had a appointment with a doctor to abort the child. husband went to Bombay High court for injunction against abortion and challenged the constitutional validity of Medical Termination of Pregnancy Act and asked for the custody of the child after birth and in the same proceeding he also filed a petition for divorce. In this case jurisdiction is the biggest issue as constitutional validity of MTP would be filed under art 226 of Constitution and in the same proceeding he also filed divorce which is and appeal against the impugned order of the family court. As High court has the inherent power to conjunct cases which would be pertaining to the same party. But in this case whether high court has the power to conjunct cases of two different nature an original application and and appeal in the same proceeding. Please help me with this case.

  • vipul says : Ancestral Property
sir, There is a partyA(died), she was a Govt employee. Govt allotted some land to her and she paid all amount to Govt. She has two sons PartyB and Partyc. Before PartyA died she made a will on the plain papper with a revenue stamp signature across it stating that after her death her property should be given to childrens of partyB and partyc. They both together have 7 childrens. Govt made a registered sale deed document on the name of PartyC and wife of partyB(as party B and partA died). Not sure why Govt registered on her sons and not on grand daughters according to her will Now at present childrens of Partyc are married. Partyc and wife of PartyB had a registered partition deed among themselves without including their childrens. partyc constructed a building after having the partition and i was unaware of the will and i purchased ground floor by having registered sale deed. Now after 2 years PartC daughters approached court for their share as her grand mother had left will on their name. PartyC daughetrs are claiming the partition deed between Partyc and wife of partyB is not correct as they are not included in partion according to their grand mother's will. PartyC daughters has not included me in the court suit. As they have approached court for their share and we have purchase based on the Govt sale deed to partC and wife of party B and partition deed between them, what implication could happen to us. What are the measures we need to take. Can court dismiss the partition deed between PartC and wife of PartB. Please provide your suggestions as i am confused as what i need to do in this scenario.

  • steve says : DATE AND SIGNATURE ON A OFFICIAL DOCUMENT
Sir, I am a government employee. I had received an official letter consisting two pages from individual concerned which is computer typed and it has been signed with date of 12th February'2012. On that said letter three lines are handwritten and again a signature has been put just below the handwritten lines but this signature is without any date. I have processed the letter in file in a routine matter. Now my department has issued me a memo alleging that I have met the individual concerned on 13th Feb'2012 and dictated/instructed him the lines which have been handwritten. But genuinely speaking this is false allegation. I never did so. I need expert legal opinion with regard to the rules that if a letter has been signed on 12th Feb'2012 it cannot be said to have been amended by hand on 13th Feb'2012. If it is amended on 13th Feb'2012 the date of signature should be 13th Feb'2012. Pl help me coz i need justice. I am very much tensed as i did not even dream of such type of allegations against me.
