Whether terrace is a common area

My client has purchased third floor of a commercial complex. In the sale deed there is no word about the rights of terrace. Subsequently the the building developer sold the terrace along with UDS to the vendor of the Building(Issue of title is there)and the vendor is trying to construct building above the terrace. . whether my client and other flat owners could object such construction on the ground of common area(Terrace)
