The OS suite it was been decided for partition in favour of petitioner and defended was not able to attend the case due to serious health issue. After that defended filed RA suite but still pending.
The petitioner filed now FDP. When RA is pending can FDP will be in favour of petitioner?
What are the steps needs to taken by defended to defend the case. kindly advice.

Once an appeal is pending the final decree petition will be kept pending awaiting disposal of appeal against the pre-decree. The Defendant has already file an appeal so wait for the disposal ofthe appeal.
