1.      Well in those scenarios the instituted case will be thrown out and no party will succeed in h/er claims and will be back to square one and or sitting across 'negotiation table' crossed over lady LUCK.

2.   The unfortunate remedy here is to imbibe some element of perjury in once suit or w/s without which one party will never succeed at the end of all confirmed due process of law thus spending uncertain years in corridors of various Courts. Remember India's gender biased family laws encourages one spouse to get away with charges of perjury and even one pecuniary Rape suit was supported by AG of a State to seek pardon of so called 'female victim' to get away from charges of perjury. So "jugad' is the only keyword as required one may / may not use to once favour if success is the only desired relief one is chasing in family courts instead of ‘contest till seeing her grey haired’.

Mere allegation does not entitle to give you any remedy. In every case ,there is a proof ,either your side or opposite side.

tajobs is right ,your case is throw out if you dont have any evidences (proof )on your side.
