Wall constructed on 4 sides of our plot without giving a way

Hi Respected Forum Members!

 

My Father purchased a Non Layout Agricultural plot of 900 Sq.Yds in  the Year 2006 in Andhra Pradesh, while all its surrounding Lands remained as Agricultural lands. In our Registered Sale Deed only the Site  boundaries and its Persons names are mentioned on the 4 sides without mentioning the Way or Passage into/out of the Site. Later in the same Year after few Months a Property Developer made Agreement of Sale cum GPA for appx 20-25 acers from All the Farmers around my father purchased 900 sq yds and got permission from the Municipal Authorities and made them into Saleable venture Layout Plots. Later he build a Wall on the four sides of our Plot mentioning that we dont have any Passage mentioned in our Registered Document with a wrong intention to buy our site cheaply and offered very low price and we refused and the situation remained same still now. As years passed, He sold plots On the left, right and back side of our Site to other people and on the front side eventhough we have a 30 ft road which was built by him during venture development (But this road Doesnt Exist at the time my father purchased the site). Also He kept appx 20-30 sq yds on the front side of our site and constructed a wall in his site throughout our site front extent just between our site & drainage line and the abutting 30 ft road.  So, My Question to the Respected members in this forum is will it be possible for us to get a Way legally?

You had been remaining silent with the problem for a period of more than two decades without taking any action so far.

However you still can seek easement rights for ingress and egress to road access from your property.

You may consult an advocate in the local and proceed as suggested.

Thank you Sir for the valuable information. Actually we offered him to buy our land a bit less than market price OR sell his small piece of land in which he constructed the wall & he refused because he wishes to buy it cheaply. 

One more thing on the other side of the site(Back side) & to the left a another road of 30 ft out of which Only 10 ft hitting the wall(Nyruthi). May be authorities will break around 10 ft of wall and give access into my site if requested. However, As per vastu or especially to obtain building permission this 10 ft road might not serve the purpose as abutting road needs to be 30 ft as per A.P building G.O.

So, I Request to enlighten me about

1) if there is any other way to obtain full access to the road?

2) Any provision in the UDA Andhra Pradesh rules & regulations for venture plotting that Developer shouldnt block anyone from accessing roads that doesnt gave to venture developer?

3) how much time it takes to deliver justice if I approach court?

Under the Indian Easements Act, 1882, if your land becomes landlocked due to someone’s act, you are entitled to claim a Right of Way by Necessity.

If you previously had access through that side, or your property has no reasonable usable access, you can file a Civil Suit for Declaration and mandatory Injunction seeking removal of the wall, restoration of access, permanent injunction against future obstruction.Court can order demolition of illegal obstruction.If the developer created an approved layout and is blocking access illegally, you may complain to The Andhra Pradesh Capital Region Development Authority (if in CRDA limits) or  respective UDA (e.g., VUDA / DTCP jurisdiction).

Under AP layout approval norms, roads shown in approved layout become public access roads. Developer cannot block public roads after approval.If he constructed compound wall over approved road space, authorities can demolish it.

Time taken by Civil Suit in Andhra Pradesh for Temporary injunction: 1–6 months, for Full trial: 3–8 years (sometimes longer). However, if you file for Interim Mandatory Injunction, court may pass  status quo order immediately or direct removal temporarily.If matter involves public road encroachment then a Writ Petition in High Court may give faster relief (6–12 months).

Nothing more to add in given facts and circumstances.

It would be better to contact, consult and engage a local prudent lawyer for proper appreciation of facts/documents, professional advise and necessary proceeding.
