Validity of release deed

Dear Sir/Madam,

X & Y are two brothers. There are some properties registered in the name of their mother.

While their mother was still alive in the year 2008, X executes ‘Release Deed’  in favour of Y in lieu of certain sum.  As per Release Deed, X relinquishes all his rights over the properties of his mother.  After the death of mother in the year 2013, the ‘X’ again approaches ‘Y ‘for his share in mother’s property.

Kindly advise if ‘X’ has any legal right to again seek his share in mother’s property despite the fact that he has already executed the Relinquishment Deed in favour of ‘Y’ during the life time of their mother. If at all he approaches the Court, will his Petition not be dismissed on grounds of expiry of limitation period?

 A Release,  signifies the satisfaction or termination of a condition or a right. An Agreement to release in future is also valid as any other contract, if it otherwise satisfies legal requirements. Such an agreement does not operate immediately, but will entail a further document such as Release Deed and can also be made enforceable.
