Dear All,
I am pursuing illegal-mining complaints and have already obtained directions from the Hon'ble High Court in W.P.(MD) No.3305/2026 dated 05.03.2026. The Hon'ble Court had recorded approximately 54,631 cubic metres of minerals being quarried. Subsequently, I came to know of and identified additional alleged illegal-mining activities in nearby villages which, according to my assessment, involve more than ten times the quantity mentioned in the above High Court proceedings. I am therefore pursuing further RTIs to obtain official records and planning to file a separate writ petition regarding these additional illegal-mining activities. I am also considering contempt proceedings due to alleged non-compliance with the High Court's directions. Recently, circumstances have created a genuine apprehension of retaliation/physical harm.
I seek advice from advocates on the following:
1. What is the best legal procedure to seek immediate police protection and a formal threat assessment from senior police authorities?
2. Since my apprehension concerns persons connected with the illegal-mining activities, should I mention their names, addresses and mobile numbers in the protection complaint? Is it legally safer to state that I "suspect their involvement" rather than directly accuse them of planning an attack?
3. If I provide names and mobile numbers, can I request the police to lawfully verify CDRs, communications, location/electronic evidence and other records to determine whether they are connected with any threat or surveillance? Will the police inform the complainant about the outcome?
4. Can I seek protection under the Witness Protection Scheme, 2018 / Section 398 BNSS, even though my role is primarily that of a complainant/petitioner pursuing illegal-mining cases?
5. Since I have apprehension regarding the local police, can I request that the threat assessment/enquiry be conducted by a senior officer or agency independent of the local police station?
6. Can I approach the High Court separately for police protection and independent threat assessment, or should this be sought along with my proposed contempt petition?
7. Can the High Court direct CBCID, SIT or another independent agency to investigate if there is an attempt on my life, instead of allowing the local police to investigate?
8. More importantly, can I seek a prospective direction now that if I suffer any suspicious accident, attack, attempted murder or death, the investigation should immediately be entrusted to an independent agency, considering my present apprehension regarding local police?
9. If such a prospective direction is legally possible, what is the appropriate writ/prayer and legal provision for seeking it?
10. Can I request advance directions for preservation of CDRs, CCTV, forensic evidence, vehicle examination, post-mortem/video recording and independent supervision if any suspicious incident occurs?
11. What is the best overall legal strategy: (a) higher-police protection representation, (b) Witness Protection Scheme, (c) separate High Court writ petition, (d) contempt petition, or (e) a combination of these?
12. Since the Hon'ble High Court has already passed the above order in W.P.(MD) No.3305/2026, should I approach the same Bench in the existing proceedings for protection and directions regarding the present threat, or would it be legally preferable to file a separate Criminal Original Petition (or other appropriate proceeding) seeking police protection, independent investigation and related safeguards? What would be the appropriate procedural remedy?
I would particularly appreciate advice based on Indian law, the BNSS, Witness Protection Scheme and relevant High Court/Supreme Court precedents.
