Validity of attached agreement of partition related to path

Please suggest the attached mutual agreement between the two brothers is valid or not and the solution for justice.  Both have sold the land long back and the person who purchased the front land has captured the path/passage given to the backside land shareholder who has also sold the land.

1. The backside lands were purchased after this agreement

2. The path in one direction is mentioned in the sale deed but there is no sign of the front landowner

3. The front land is also sold and all of the lands is captured including the path given in the agreement

Note: Both the original landowner is still live

Intention: The intention of the front part-owner is to harass the backside landowners so that they will sell the land to him at a very cheap rate
