To cancel the selling agreement

Hello respected Lawyers out here...

the issue is regarding which i seek ur suggestions is about the sale agreement which we had done with the other party in april 2014 with the range of 30 days...

the time has passed and even we r not willing to sell the property. we have received the advance amount of 35 lakhs in which only 25 lakhs is mentioned in the agreement. the rest 10 lakhs he gave us cheques and is not entered in the agreement about it..

there is no clause in the agreement regarding the cancellation of it or to pay any damages in the case of cancellation.

so, now whn v dont want to sell the property to him, he is claiming 10lakhs and also threatning us to breakover the locks of the house and take the position.. the house is in vacant position and away from r native.

so, i seek ur sugesstions on it and help me for further proceedings.

Find out the amicable solution there is no use to fight with eachother , canceled your sale agreement and return all his 35 lakhs to him and take the sign receipt from him duly sign by two witnesses on it .
