Tenant parking charges

Hello,


I am renting out my flat in a cooperative housing society in Mumbai south. The parking is open parking and not reserved parking since there is ample parking space and we are allowed one parking per member in the building.


I spoke to the chairman about my intention to let the flat out. He has informed me that tenant car parking will be charged at Rs 1200/- per month.

1. Can a society levy such a charge when I am eligible for one parking and also when there is ample car parking space. I am simply giving my parking area to the tenant.

2. If they can legally levy such a charge, then can I continue to park my car along with the tenants car?


I look forward to some technical feedback and advise on the same.
