Ten years qualifying service

I had served in Defence Accounts Department for 20 years and I applied through proper channel for a position in an Autonomous Organisation under Central Government which also has a Pension Scheme and follows the CCS (Pension) Rules.

On selection, I joined the Organisation  and on leaving the Defence Accounts Department paid me terminal benefits (after a Medical Board) as a one-time settlement.

After serving in the Autonomous Organisation for 18 years and on attaining the age of 60 years I retired from the Autonomous Organisation. Since I did NOT get my past service counted in the Autonomous Organisation I was paid pro-rata pension on pro-rata basis [ ie 50% of last pay drawn for 18/33 years service] which I am receiving for the last almost 4 years.

Now the Govt of India, Min of P & PW vide their OM No. F.No. 38/37/08- P&PW(A) dated 10.12.2009 have directed that pro-rata benefits will NOT be linked with 33 years of service and that those employees who have completed 10 years of service will be granted 50% of last pay drawn.

I have 18 years of qualified service for grant of  pro-rata benefits in the Autonomous Organisation and as per the afore-said order dated 10-12-2009 only 10 years is required to be eligible for payment of 50% of last pay drawn as pension.

My office personnel are not inclined to oblige as they say (verbally) that I have received pro-rata One-time settlement from Defence Accounts Department in 1990 & that this would tantamount to grant of two pensions??

Kindly clarify whether I would also be entitled to the benefits which accrue from implementation of the above mentioned order dated 10-12-2009. Kindly apprise me of the relevant Rule number in CCS (Pension) Rules or any govt Order issued in this regard.
[As of today I am in receipt of pro-rata pension @ 18/33 of 50% of last pay drawn + Grade Pay.]

Sir,

Yes, I had submitted an application to the Office. The application is appended below.

        I had joined this Institute on 3-1-1990 as Asst. Admn. Officer and was granted two advance increments on joining. Prior to that I was working as Asst. Accts. Officer in the Defence Accounts Department.

        I was selected for the post of Admin Officer in the Institute & joined the same of 28.8.1990.

        After rendering 18 years of service and consequent on attaining the age of superannuation, ie. 60 years on 3-1 2008, I was transferred to Pension Establishment on 31 Jan 2008  and was paid terminal Pensionery benefits.

        Leave Encashment for 240 days and Gratuity for 21 years of service was deducted from my terminal benefits as they were already disbursed to me by my previous employer.

        I was paid pro-rata pensionery benefits by this Institute for 18 years of service rendered in this Institute.

        Govt. of India, Deptt of Pen & P.W. vide their O.M. No. F. No.38/37/08-P&PW(A) dated 10 December 2009 have now directed that in respect of all those employees who have completed ten years of qualifying service, and have superannuated, their pension may be disbursed @ 50% of last Pay plus Grade Pay.

        These orders are effective with effect from 1-1-2006 onwards.

        I request that Commutation of Pension as well as arrears of revised monthly Pension may please be disbursed to me.
