Technical resignation/ lien matter
I join my duty on date 29/11/2010 as Tax Assistant in Central Excise, Ahmedabad-II Commissionerate. After getting selected as Labour Enforcement Officer, in the Labour Department, Govt. of Bihar, I have submitted Technical Resignation. The competent authority has accepted the same with Lien period for two years, and relieved on 20.12.2013. Further, I have requested to revert back to my substantive post of “Tax Assistant” in the Commissionerate of Central Excise, Ahmedabad-II by availing the provision made under the Rule 26(2) of CSS (Pension) Rule 1972. Vide Estt. Order No. 26/2014 dated 23.07.2014, the Additional Commissioner (P&V), Central Excise, Ahmedabad-II has considered the same and allowed me to join duty as Tax Assistant in Central Excise, Ahmedabad-II. I resumed my duty as Tax Assistant in Central Excise, Ahmedabad-II Commissionerate on date 15.09.2014.
Meanwhile, Vide Estt. Order No. 37/2014 dated 12.05.2014 issued by the Additional Commissioner (CCO), Vadodara Zone, Vadodara, my immediate junior most Tax Assistant (Sr. No. 59 to 70) has been promoted to the grade of Sr. Tax Assistant as per Seniority list-2013. Therefore, I have made several representations to retain my seniority to the immediate junior i.e. Shri Sandand Malik, S.T.A. and consider regular promotion in the grade of Senior Tax Assistant from retrospective effect i.e. 12.05.2014. Vide Estt. Order No. 06/2016 dated 21.01.2016, I got promotion to the grade of Senior Tax Assistant with immediate effect whereas I should have been promoted with retrospective effect i.e. 12.05.2014. Therefore, I again submitted representation to the Chief Commissioner Office, Vadodara Zone, Gujarat with request to grant me promotion in the grade of S.T.A. with retrospective effect i.e. 12.05.2014 and retain my seniority immediate above to Shri Sandand Malik, S.T.A. as per seniority list of 2015.
