succession certificate

My mother didn't left any will...after her death bank had asked for succession certificate to close her pension and after accounts. we are 3....2 brother and 1 sister. I am married. Is it necessary to declare all 3 names in succession certificate. ....as I don't want anything from them.. I want both to have everything. ...how I can remve my name from succession certificate. .. after that will it be easy for them to claim easily..

Hope the matter pertains to all a/c's maintained in Bank.


In case of deceased depositor a/c with nomination and without nomination RBI has advocated guidelines that each bank has to follow and has to maintain the guidelines and bank's guidelines framed in line with RBI guidelines on the website, in branch and has to provide printed version without any cost to legal heirs/successors.


YOu may go thru: Master Circular on Customer Service in banks:

20.Settlement of claims in respect of deceased depositors –Simplification of Procedure: 20.1, 20.2

If the a/c is with nomination: Succession Certificate is not required.

If the a/c is without nomination looking into Min. Threshold limit succession certificate may be required. Even in such case bank can close the pension a/c and other a/c's by obtaining 'Disclaimer', 'letter of indemnity from legal heir' an sureties.

If succession certificate is required then it has to be obtained from Civil court/HC within whose jurisdiction the estate of the deceased falls and as per  pecuniary jurisdiction ( depending upon the value of the estate of the deceased). Your lawyer dealing in such/revenue/civil matters can help you with it.

 

You can relinquish your rights in favor of your brothers by a registered relinquishment deed
