Stamp duty and registration

Dear Sir,

In our society (borivali – Mumbai) we have 166 flats consist of 5 buildings, first building constructed in 1978 and we are planning to go for Conveyance/Deemed conveyance. I would appreciate if you can help us to solve following queries.

Questions:-

  1. What will be the Process if stamp duty (post 10/12/1985) is not paid by the individual flat owner while buying the flat and what will be the calculation for stamp duty.
  2. What is the process if stamp duty paid but not registered?
  3. Flat is in the name of Grand father or Grand mother need to transfer to the legal heir.
  4. Process for getting OC or CC document if builder is not applied, though building constructed in the year 1990 .
  5. One Of the flat owners Chain Agreement is missing then what will be the process.
  6. Minimum number required to pass resolution for redevelopment.

1) As per currnet ready reckoner rate stamp duty is to be paid.

2) Registed it under SRO. Plz state fact of case.  Law can't be interpreted on if and but.

3) If society is formed then take NOC from society and get the share certificate of ur Grand father.

Mutated it in your name.

4) OC or CC will be given by Competent Authority who had given work commmencement  certificate.

5) Certified copy of agreement can be obtained from SRO.

6) 2/3 rd of majority i.e. 166X2/3=111 members consent.
