Spicejet is violating their own t&c

My SpiceJet flight was cancelled 1 week before the scheduled departure. On seeking for a compensation, SpiceJet keeps quoting their Terms & Conditions (corporate.spicejet.com/Tnc.aspx) incorrectly. Under the section "Cancellations, Changes, and Delay Policies", sub-section 2: "Cancellation Initiated by the Airline:", Point-1 states the following: Passenger(s) who have provided a correct and working mobile number or e-mail at the time of reservation and have been informed about flight cancellation at least two weeks before the scheduled time of departure shall be entitled to an alternate flight or a full refund, as per their preference. However, if passengers are informed of the cancellation less than two weeks before and up to 24 hours before the scheduled time of departure, SpiceJet shall offer an alternate flight or provide a full refund if no suitable alternative is available. Point-3 states the following: SpiceJet will provide an alternate flight that is acceptable to the passenger. Point-4 states the following: In the event that an alternate flight is not provided, SpiceJet will offer compensation in addition to a full refund of the air ticket. The compensation provided by SpiceJet will be in accordance with the compensation policy outlined by the airline, as mentioned below: INR 5,000 or booked one-way basic fare plus airline fuel charge, whichever is less for flights having a block time of 01 hour or less. INR 7,500 or booked one-way basic fare plus airline fuel charge, whichever is less for flights having block time of more than 01 hour and up to and including 02 hours. INR 10,000 or booked one-way basic fare plus airline fuel charge, whichever is less for flights having a block time of more than 02 hours. - As you can see, my flight was cancelled exactly 1 week before its departure. (This constitutes to point-1 coming into effect) - SpiceJet did not have any alternate flights that they could provide me with. - SpiceJet did not have any partnerships with any other airlines to provide me an alternate flight. - Above points constitutes to point-3 not being fulfilled. The above points were confirmed over a call with SpiceJet. - Due to all this, point-4 comes into effect. On stating the same, SpiceJet interprets their own Terms and Conditions differently. The initial ticket price for 4 passengers with SpiceJet was around Rs. 17000. Since I had to book the tickets with another airline only 1 week before the departure, the prices increased to Rs. 37000. SpiceJet blatantly refuses to compensate me for the financial burden caused. I've raised this through the airsewa portal. The latest update is that SpiceJet is offering me a Rs. 1000 voucher per passenger which is completely unacceptable to me. Are my interpretations of the T&C correct and valid? How can I proceed further?

Your interpretation may be correct but it is always better that you consult an experienced lawyer and send a legal notice demanding your entitlement as per the terms and conditions, failing to respond properly, you have an option to approach consumer commission with a complaint for deficiency in service and unfair trade practice.

Question too long to reply.

No opinion can be formed on the basis of incomplete and vague facts posted.

It is better to consult and engage a local prudent lawyer for proper analyses of facts/documents, professional advise and necessary proceeding.
