Social marraige can also get a devource for second marriage

Sir...mai aplogo se 1 question krna chahta hu...mai jisko pyar krta hu wo already married hai but happyly nhi rehti hai kvi...uska husband v utna accha nhi hai na hi job m na hi family m na hi body m to jiske wjah se uss ki wife k upper pressure agya hai job krne ka ghar ka kaam krne ka...wo mujh se shadi krna chahti hai...or wo shadi social marraige hua tha...to iss condition m mai kya usse shadi kr sakta hu ya nhi

Is case mein jo female hai vo married hai, aur India mein koi bhi Personal law Polyandry to allow nahi karta. Agar vo aapse shaadi karna chahti hai to unko pehle apne husband se divorce lena hoga personal law ke hisaab se.

Marriage agar registered hai to phir divorce mandatory hai, agar marriage registered nahi hai aur personal law ke hisaab se valid bhi nahi hai to shayad usey challenge kiya jaa sakta hai lekin agar saari conditions fulfilled hai to voh marriage maani jayegi aur divorce lekar hi dusri shaadi ho sakti hai.

Baaki har personal law ke details alag hotey hain. Is case mein jo bhi involved hai unke religion ke basis pe hi determine hoga ki kaunsa law aap logo par apply hoga.

Since the female is the one who is married here, she'll have to obtain a divorce before proceeding for a second marriage as no personal law in India permits Polyandry as such.

If the marriage is registered, then there has to be a lawful divorce, however if the marriage does not satisfy any condition under the concerned Personal law, then perhaps it can be challenged on such grounds. However, if all the conditions are satisfied duly, a divorce, as I said, would be necessary.

Rest assured, Personal laws vary from religion to religion and the religions of the persons involved in this case will only determine as to what particular law will be applicable on the concerned parties.

Jis majhab se vo talluk rakhti hain uske anusar lagoo personal law ke mutabik talak lena chahiye.
