Seek your valuable help on filing a defaming suit

 

I have filed a writ in the high court against an illegal pig and poultry farm just 15 meters away from my house. The court gave verdict in favour of me but after filing this writ the owner of the farm files lot of complaints against me in different offices like Panhcayath (8 complaints), Village (6), Police Offices (around 5), District Collector, Chief Minister, Vigilance etc. saying that I am doing lot of land mafia activities, dealing with black money, etc. Now every week I have to go myself to one or the other office to prove my innocence and till now no action has been taken by any of them. But still I am wasting lot of my time, money, fame etc. Is there any way that I could file a writ in preferably high court against this.

Certainly - the scope and ambit of A.266 is really wide - all these frivolous complaints are clearly malicious and meant to settle personal scores and are vindictive, file a writ making all these departments party seeking directions for complaints to be closed down.

I want to know where can one file defamation case?

At a place of his residence or where the the false case filed.

Dear Querist

The WRIT Jurisdiction under Art. 226/227 of Indian Constitution is HC and in Article 32 the jurisdiction is in SC. why are you waste your time in Writ and all that, file a defemation suit against him and also a criminal case for extortion against him. practically only one case should be registered against him he will come to his knee and beg to you.

Writ is the way out if false cases have been registered against you on the basis of the complaints filed by this man. File it in the High Court. You cannot directly approach the SC bypassing the High Court in a case like this. Filing a defamation suit can also be considered depending on the allegations in the complaint(s).
