Need help with legal heir certificate

nhave recently lost both my parents, both were private employees. They had no will and now I need to get my parent's vehicle and property transferred to my name. The property is located in Andhra Pradesh, but I'm currently in Telangana.

I have a few questions:

Which certificate do I actually need? Is a legal heir certificate the right document for transferring both a vehicle and immovable property or would something else be required depending on the asset.

Whom should I approach? Since the property is in Andhra Pradesh but I'm in Telangana, do I apply in Telangana or Andhra Pradesh.

I've spoken to a few agents, some quote very high(in lakhs)some lower(in thousands).

Quick Summary
Following the recent passing of both parents, who were private employees and left no will, the user requires guidance on transferring their vehicle and property. They are unsure if a legal heir certificate is sufficient for both assets or if different documents are needed. The user also seeks clarification on the correct authority to approach for the certificate, given they are in Telangana while the property is in Andhra Pradesh. They've encountered varied agent quotes and are questioning the legitimacy of high fees, noting the low government cost for a legal heir certificate.

The government fee for a legal heir certificate in India is very low, usually ranging from ₹20 to ₹200, depending on the state. NoBroker Breakdown of Costs Application and Stamp Duty: The official application fee or stamp duty typically costs between ₹2 and ₹20. Affidavit: A self-undertaking affidavit on a stamp paper for family details generally costs around ₹20 to ₹50. Notary or Professional Charges: If you hire a lawyer or use a notary to draft the affidavit and handle the paperwork, extra professional fees may apply, ranging from a few thousand rupees upwards depending on the practitioner. CRSPL +3 Important Distinction: Legal Heir vs. Succession Certificate Do not confuse a legal heir certificate with a succession certificate, which involves court involvement

A succession certificate is a legal document issued by a civil court under the Indian Succession Act, 1925, that grants legal heirs the authority to claim movable assets, debts, and securities of a person who died without a will. Step-by-Step Process to Obtain a Succession Certificate • Determine jurisdiction: File a formal petition before the District Judge or a principal civil court of original jurisdiction where the deceased ordinarily resided at the time of death, or where their property is located. • Draft the petition: Include details like the time and place of death, residential address, names and residences of family members/legal heirs, the applicant's right to claim, and a specific list of debts and securities. • Gather documents: Attach the original death certificate, identity proofs of legal heirs (Aadhaar, PAN), relationship proofs, and a No Objection Certificate (NOC) from other legal heirs if possible. • Pay court fees: Pay the required court fee, which is typically calculated as a percentage of the total value of the assets requested.

Obtain legal heir / Surviving Member Certificate from area SDM/ Tehsildar where your parents lived and died. File an application with LR /SMC to the MRO where vehicle is registered.

Move to area Civil Court where property is located for transfer of properties through a local prudent lawyer.

Why you are running after agents. The certificate is to applied within the urisdiction your parents had domicile. In most of the States, the Revenue Officers are issuing legal heir certificate. As to the Succession Certificate, the competent Civil Court needs to be approached.

For transferring both a vehicle and immovable property (land, residential plot, or house), a Legal Heir Certificate (officially called a Family Member Certificate or FMC in both AP and Telangana) is typically the correct administrative document.

Approach the Local Sub-Registrar Office (SRO) in AP: Property transfers and title registrations are strictly tied to the physical location of the land/house in Andhra Pradesh.

Relinquishment / Release Deed (If applicable): If you have siblings or other surviving Class-I legal heirs, all heirs inherit equal shares. If they intend to relinquish their share so the property is solely in your name, they will need to execute a Registered Release Deed / Relinquishment Deed or Settlement Deed at the SRO in AP.

Mutation (Revenue Records): Once the registered deed/FMC is ready, apply for revenue mutation through the AP Webland/Spandana portal to update the village accounts, Pattadar Passbook, and property tax records into your name.
