same flat sold to 2 people

hello i had purchased flat in 2004 and suppose to get possession by 2006
builder failed to do so we filed a case in 2010 matter went in our favour and bank asked to give possession now after few execution dates we got our flats sealed and now builder has to give possession but now after this some party has arised claiming that he has purchased this flat in 2010 and bank loan is also going on the flat and hes paying regular emi but builder his delaying him for possession.
please sugesset me some thing after 14 year we got possession and now this problem
plesase answer my question
1 who is the orignal owner of the flat
2 can bank give loan and dedect emi

You are the 1st buyer…as per your post..

Approach your own very able senior LOCAL counsel of unshakable repute and integrity specializing in civil/consumer matters and having successful track record ….. and worth his/her salt …and discuss in person and even with seasoned PIP to draft as per facts of the matter and proceed in best of your interest.. ….and counter other side…….

Your counsel may opine to initiate civil, criminal proceedings against the seller/builder and attach his/establishment’s estate before he/establishment ….disappears..
