I am Lingaraj SC. residing at shivanagar bangalore karnataka.
i am staying in a rented house since 01-04-2012 which is in shivanagar.
i paid a security deposit of 75000 and agreed to pay a rent of 8250-8500 ( including electricity bill).
owner did not give us the rental agreement and we asked for the same and in turn replied that he will get some tax on that income. We accepted it as we needed the house badly to stay, thinking he is a quite a gentlemen and i can adjust for small disputes. later to get the gas connection i asked the agreement and he gave me the same.
3 months back we decided to move to new house because of his daily tortures and called him and said that we will vacate in 2 months as per the agreement. he said i need 3 month time to settle the security deposit. we accepted to that also. now when i asked him about the settlement of amount, he is saying 20000-30000 rs of amount for painting and maintainnance. when i said him its nominal of 1 month rent he says he has given the house for rent for lesser amount and he painted with 4 coats. now he will get a painter and estimates based on that he will charge. in the agreement he has mentioned only " panting and maintainnance charge should be paid by tenant to owner" but he has not mentioned how much it will be. now he is demanding 20k-30k. please help me in handling this. can i give a police complaint or raise this to consumer court. i dont have valid rental agreement.
