Regards reliving letter and pf transfer

Dear Sir/Madam Kindly guide me on my issue. I have resigned from my ex-employer within a week time of 90 days notice period.stating short service due to emergency requirement at my present employer. I have said all the reasons why I am the ex-employer to HR and CEO and written the reliving date as one week and I am ready to pay the 3 months gross salary in lieu of my short service. But now the HR of ex-employer is forcing me to do the 90 days notice only then the reliving letter will be provided.I have my PF amount for my 2.5years working with that. Please guide me on this case,because now I have joined my new company and I can't continue there even i have said to ex-HR but he his forcing me still. He sent a letter that I came out of the company without informing them. But in my case I have clearly have contents of resignation letter produced, mail sent by Regional head to HR on my one week reliving.ve The ego of HR is I have not asked him a word on reliving.

Does the appointment letter, standing orders (model/certified), service rules/conditions  provide for notice pay in lieu of notice period?

 

If yes submit reply under proper acknowledgment citing the clauses and attach copies of notice and emails etc of RM etc and deny that you have left without  any information and ask to call back false allegations and mention that as per notice company should have arranged for formalties if any, and that NO tasks were pending at your end. Keep appointing authority,MD, Chairman in copy and demand to supply the acknowledgment and acceptance of resignation, service certificate,relieving letter withtout any adverse comments and with all achievments, correct FnF statement, Form16 as per correct FnF statement, salary slips of all months, PF a/c statement of each year, NOC/NDC etc..............

 

The 90 days notice period even if inserted in appointment letter may not be neccessarily applicable.

 

If good offices also do not provide any relief you may approach an able counsel specializing in labor-service matters.

If the PF a/c is with EPFO then employer has no control. You can transfer the PF thru current employer.
