Notary fee

can notaries charge more than the fee prescribed by the notary rules? Is this legal? Is the fee list of notary rules not mandatory?

For attestation of affidavit and agreement prescribed fee is only 35 , when notary charge 100, 200 ,500 etc.

I think Prescribed fee is not sufficient today . But I want know that notaries can charge more then 35 rs . For attestation of affidavit , agreement etc. ?

No. The Notary shall collect the fees as per the rules prevailing in the state.

Sorry sir but no rules make by state about notary fee . There is only central govt. Rules which mentioned notary fee is 35 rs for attesting affidavit and agreement , which is very insufficient .

It is only Rs 35/- per the Notary Rules,1956.

Notaries in India are required to adhere to the fee structure prescribed under the Notaries Rules, 1956. According to Rule 10, notaries cannot charge more than the prescribed fee for various notarial acts. The fee list is mandatory, and notaries must display it prominently inside and outside their office. Charging fees beyond the prescribed limit is not legal and could lead to disciplinary action.

A notary public in India cannot charge fees beyond the government-prescribed fees. The Notaries Act, 1952 and the Notaries Rules, 1956 specify the fees that can be charged for various notarial acts. 

Failure to adhere to these prescribed rates may lead to disciplinary action, including the cancellation of the notary's certificate and potential debarment from practicing, according to the Notaries Act, 1952 and Notaries Rules, 1956. 

The rates of, fees to be charged by a notary shall be displayed by him in conspicuous place inside as well as outside his chamber or office.
