Let your father submit a terse representation addressed to the appointing authority by redg. post narrating all representations made so far by emails, letters, in person (mention date, phone numbers, name of company official-designation-dept-name of company-address) and POD detail of each time and total number of time PF forms have been submitted for withdrawal of PF, and conclude that although the duly filled in forms have been submitted company has willfully and intentional not complied to its duty to submit the forms and supply you the acknowledgment issued by PF office.

You may demand the PF number, PF a/c slips/pass book from company for entire tenure of service, by redg. post only.

PF: The funds accumulated in PF a/c of the member maintained with EPFO are not in the control of employer.

You may demand this acknowledgment by redg. post only.

You may indicate that you are contemplating to approach lawful authority and court of law.

The redg. post can be tracked at:

www.indiapost.gov.in

and submit the delivery report from website to concerned official of the company by email as well if you want to.

However you may obtain POD from sub postmaster (one free of cost and certified copy of the run sheet of the postman by paying a fee of Rs.10/) for having delivered the PF forms.

Company should submit the forms within 5 days. The declinature to attest PF forms is offence.

The employee can submit the PF forms direct to concerned PF office where the PF a/c of the member is maintained or thru nearest PF office. However obtain the acknowledgment.

Meet RPFC in person, with copies of salary slips showing deduction of employee's contribution, and copy of complaint made to appointing authority and POD of all previous submission to company. Lodge a complaint in writing under acknowledgment to depute PF official and penalize the company.

Escalate to RPFC, Addl.CPFC of the state, CPFC, in writing, under acknowledgment.

If you have any doubt on default on payments by company to PF office Obtain copy of Form 3A,6A,23,24 by RTI from PF office.

Sudhir Kumar, Advocate (Advocate)     13 May 2013

first of all your father has to ascertain by RTI if the F/19 is submitted by company or noit.  If not then give a complaint to RPFC.  NON-SUBMISSION OF CLAIM FORM IS CRIMINAL ACTION ON THE PART OF COMPANY.
