Pre marriage agreement

Dear Sirs/ Madams

I am in fix. I have two sons aged 30 and 33. Both are independent. Both are scared to get married. We have brought them up God fearing Good valued individuals. Some of their friends are married, most are arranged marriages and they are warning them saying the life after marriage is terrible. The girls now are not what they appear to be. For some of them marriage is a business. They get married and after few months or weeks they'll file case against the groom saying dowry harrasment and domestic violence. There after they are after the hefty alimony and share of the boys property. As the law favour them, the boys party ends up loosing everything including his parents hard earned money and property.

My query is that, is there a provision in Indian laws for a pre marriage agreement. Which states that, the boys do not take any dowry and the girls can keep all they brought with them. Like gold or so. In return the girl and her relatives will not ask for alimony or any consideration from the boys. If there is any child, The responsibility should be equal for both parties and according to the financial status of each party.

This the situation with most of their friends.

Greatful if you could advise me in the right direction.

Thank you

With best regards

Parmod

There is no premarriage agreement as per law.

No marriage  will  take  place  if one  party ask for  pre marriage  agreement.

Even if  both  parties  agree, and  wrote a  statement, the  same  is  not  having  any legal  advantage.

The  bride side  may  say that the  statement  was  signed  by  a  compulsion and  one  of the  condition  for  the  marriage.

Moreover, if something  goes  wrong,

A question  may arise  why this  agreement  has been  made  before  marriage?

Was that made  with  an intention?

This  may complicates  cases if filed.

It's  better  to  face  the  legal  issues with a prudent  lawyer when  really  requires

Such a law is yet to be passed by Parliament of India.

There's no provision in Indian law for a prenuptial agreement.

Therefore you cannot predict all such issues just because it happened to your neighbour or known people.

It is not that the same situation will prevail with everyone.

If any such event occurs later then they have to face the inevitable.

Many thanks for all your advices.

As far as I was told. There's nothing to protect the groom.

Encouraged to note Dr. J.C. Vasishta sir's reply that, Such a law is yet to be passed by Parliament of India. Means there's hope.

Thank you again

Yes, prenuptial marriage agreements are not enforceable in India and hence void ab initio.

The query suggests no legal issues or legal elements.

Prima facie, you have failed as parent. Admittedly the sons are adults and grown up. They are and they ought to be competent and capable of meeting the vagaries of life their own terms.

Everyone lives accordingly, the querist included. How there could be a different world and society and legal provisions for your sons!
