Pensioner father (non dependent) claims for my property and money reimbursement

Hello Sir, I have migrated to other state due to job in year 2000. Before that we purchased property and registration and loan done on my name. My father who retired from service (class I) with pension much higher than dependency value has given 40-50 % amount and other is loan. My father, mother along with my younger brother and his family shifted to property and enjoyed till now. I paid full loan and visiting peoprty for 2-3 days vacation. Now as my loan is paid and my father. mother has moved to my brother's flat they are claiming the house as well as reimbusment of money spent on my education. He also threated to report to my boss with my mother's name who is not dependent on me as my father is pensioner. In one hand he is harrasing thatwe have to sell the property and when I am trying to search customers he do not share the property keys to see the site. As I am located in different city I am not having keys of the property also. Now he is saying to gift him 50% of the property as he spent some mony initiallly on payment. In this senario what should my stand. Kindly guide

1.   You are the absolute owner, don't sign or transfer anything.

2.  You can legally recover possession and restrain interference through police or civil court.

3.  You may ignore threats but if harrasment continue take legal and police help.

4.  Documents every communication and take help of prudent lawyer for further action.

The registration was done in your name by taking 40 to 50% from your father and a loan.  Though your father paid some amount.  But the property is in your name and you are the owner of the property.  However, you can engage a prudent lawyer with the documents/all relevant material to get better guidance and file a case if necessary.

This property ws purchased by you on your name by a registered sale deed, hence tyour fatrher or anyone cannot claim any share in it as a right.

Howev er you may p;lease note that pensioner father can claim maintenance from his son, provided he is unable to maintain himself from his own earnings, which includes his pension.

The value of dependency is not a fixed amount but is determined on a case-by-case basis by a Maintenance Tribunal.

he crucial factor for claiming maintenance is not the source of income, but the total sufficiency of that income to meet one's needs.

A father with a pension can still claim maintenance if his pension income, combined with any other property or earnings, is not enough to provide for his normal life.

Father's  income includes his pension and any other earnings or property income. The Tribunal will evaluate if this is sufficient for his needs.

Theank you sir for your advice.

One more point just want to add that My brother's wife harassed by my father and mother and she made police complaint and then got divoced. Is the police record is helpful in this case as they are now started harrassing me and putting mental pressure to gift him 50%

Dr. J C Vashista (Advocate )     15 October 2025

No, the police  records shall not be considered in any evidence.

Are you true in mentioning that your father and mother harashed your brother's wife consequently she got divorce ?

Further you have stated that now your father and mother are pressurising you  to gift 50% of the property, are you true to your statement and conscience alleging your parents for their gains ??

Unbelievable statements.

However, show the relevant records to a local prudent lawyer for professional advise, if you are sure about your perception, which I found to be hpothetcal.

The query suggest deeper issues. It appears that you have posted only selected facts.

However, the facts posted  reveals you are the absolute owner of the property. However, the father can approach the Court to get the funds he has invested.
