None of these orders are relevant to your case. These orders pertain to retention of lien on technical resignation, not pay protection when implementation of promotion order in parent department tends to render the employee to have been placed at lower post in  the new department/ orfganization, as happened in your case.

There are a lot of instructions of the DOPT that confuses an employee, as these deal with various situations. That is why I reiteraterated on making aperfect case with reference to the correct rules, regulations and Government of India decisions. Else, you cannot escape from failure of your case, if prepared with reference to irrelevant Govt. of India decisions.

Perfectly advised by Mr. Dhingra. Nothing left on guess. In fact multifarious letters issued by the DOPT from time to time makes even the excperts confused much, what to say of a layman. Any wrong reference, if quoted in the representations or court case tends to losing of the case by the sufferer due to smart moves of the executives or their lawyers even int he courts. So, a lot of carefullness is desirable on the part of the aggrieved employees.
