I filed divorce in march 2012 n same time my wife also filed for restitution. so there were 2 case, family court cancel my petition n accepted her petition. than i moved to high court for both cases. A national lok adalat was held on 8th of april 2017, in which any how i only applied for any solution. Before court both party lawyer's, me n her brother appeared n final alimony was settled in 20 lakh. all the conditions were mentioned in the agreement from appellant me n respondent wife like appeal will be done in family court with in 1 month from date of order. sign was done all 4, wife not signed.
now i received order copy on 22 april, in which it was mentioned that appellant pray for withdrawal of appeal. pray allowed n on the terms, the present appeal is dismissed as withdrawn.
Now sir my lawyer is advising me that ur not bound to follow this order.
my Q is 1. what if i dont appeal before family court in 1 month. will it be contempt of court?
2. from which date 1 month will be counted, from 8 or 22 ?
