Gratuity is without any cost to employee.

The T&C stated by you are arbitrary.

The unions can provide support to you.

Your matter may get resolved with clean relieving.

Hope you shall appreciate that we are helping another employee to learn to catch fish than catching the fish and do spoon feeding.

 

In another thread recently in just one day employee was able to know and contact.

His issue is resolved without litigation.

Hello Sir,

I got few IT/ITES unions contact list, will contact them and also will approach labour Department if required.

Also one thing I have to highlight in offer letter salary was 42k and take home 35 k including gratuvity and other unconventionall salary cut.

I greatly apprectiate your quick and  Kind Help.

The employee has severed employer-employee relationship the moment employee has resigned.

Resignation can be without permission, notice.

 

You may ask to supply acceptance of notice and resignation, correct FnF statement ( computing everything e.g; wages, notice pay recovery etc), FnF wages, service certificate, relieving letter (with good comments), Form16, NOC/NDC, handover of charge, PF number and a/s slip etc 

Also mention to whom you should handover the charge within LWD under proper acknowledgment on the spot.

 Also mention that NO tasks are pending at your end (download the evidence).

 

Take care so that NO charge and claim for having caused loss to employer is leveled/fastened on you.

 

Apply your skills and get relieved.

 

In case of issues NOW or later approach a very able counsel specializing in Labor/Service matters and unions.

Your employer or its personnel in line management/HR have already initiated the process by declining to accept your resignation and to declare you absenting/absconding/abstaining.

 

Handle carefully.
