Not pay salary till after the resign 2 months ago

Dear Sir/Madam,

Myself Hardiksinh Chauhan. I want to file a complaint against

1) Innovamedia Publication Limited.

2) Attcomart Services Limited.

3) HAM Services. All company’s enturprionr of Vaarad Ventures Ltd. HO at Mumbai.

 

I was working in Innovamedia Publication Limited (3rd Floor, Waghela House, Besides Havmor Restaurant, Navrangpura, and Ahmedabad – 380009) as a HR Executive. I left this company on 10th Nov, 2012 after doing proper hand over but they are not paying me my last 2 month’s salary of August-September-2012

 

Also their rules and regulations are very complex and they don't clarify it prior to joining the company. Once I joined the company I got to know about all the HR policies and restrictive environment. They make employee work 216 hours a month !!! That's way more than normal IT companies in Ahmadabad. There was penalty for taking leave and if someone took one leave then including penalty it would incur up to two leaves. So, as I wasn't able to set myself up in that environment I decided to leave the company and informed HR but they never showed any interest to pay me my salary for even a single day of my work. As a HR of the Company I know that in a Single month 30 Employee left the job due to reason of Salary Problem & HR Policy. Not only me, there were 25 more colleagues with me who had also same experience. They also left the company and never got paid for last two months. I heard that there were many candidates became victim of 1) Innovamedia Publication Limited.2) Attcomart Services Limited.3) HAM Services. I would like to bring this to light so that no other person in future goes through what many people have suffered. I want to file a complaint against 1) Innovamedia Publication Limited.2) Attcomart Services Limited.3) HAM Services promised me to release my salary as per their policy but they refuse to do it and do not revert my calls. Even not provide sophisticated answer about salary & other Particulars Concern Person of Mr.Chirag Chavda & Mr.Summair Vidha who is (Operation Manager of Innovamedia Publication Limited. & AttcoMart).

 

As Per the my last Conversation with Mr. Sumair Vidha on 17-01-2013 about my salary so now talking with me in so rubbish language & show me wrong Attitude & tell me that I am not able to receive salary from company side. Even as per the mail of Chirag chavda who is working in Innovamedia Publication Limited as a Operation Manager he send me mail which details I mentioned below:-

 

This is to inform you that we have relieved you from the post of HR Executive from HAM Services limited with the immediate effect.

So please noted and your relieving date is 10.11.2012 end of working hours.

(Company terminated all employee without any notice period & Not Provide sophisticated Reason for terminate also saw you 30 Employees who terminate by company without notice & reason for terminate & not get salary of Last 2 to 4 Months also.)

 

 


Please do not trust on them.

1) Mr.Sumair Vidha (Operation Manager of Attcomaart),

is the key player of 1) Innovamedia Publication Limited.2) Attcomart Services Limited.3) HAM Services. and also they do not provide committed work to their client and also have lots of cases on bidding portals too. Their quality is worst in website development, designing and project development along with SEO services. 1) Innovamedia Publication Limited.2) Attcomart Services Limited.3) HAM Services. All company’s enturprionr of Vaarad Ventures Ltd. HO at Mumbai.

Probably your company is taking undue advantage of ill informed employees and employees are making a mistake by resorting to phone calls only.

The representations should be supplied by redg. post.

IT companies are covered under SE Act.

State of Karnataka has ended blanket exemption granted to IT companies from the provisions of IESO Act. You may file claim for wages under Payment of Wages Act as per provisions of the act.

You may obtain the latest version of the enactments from dept of labor web site of your state or buy from market. You can also meet labor officials in dept. of labor, SE Inspectorate, Wages Inspector etc…

You have posted that:

The service conditions are described in standing orders of the company and appointment letter.

Company may have been flaunting some policies in the name of HR policy, exit policy, leave policy, severance policy however all policies should be in the reach and knowledge domain of the employee. Gossip and rumor can not be rules.

If you are finding few things difficult you may consult a competent and experienced labor consultant/service lawyer well versed with labor laws of your state.

If all of you join hands you may be able to file a common claim application.

If employee has resigned with immediate effect company shall be too happy to adjust notice pay in FNF statement/settlement.

However 2 months’ notice period during training/probation can b termed unreasonable.

Notice period is part of service conditions and service conditions as in standing orders can not be negated by appointment letter.

You may look into model standing orders {IESO Act} if applicable to your company and

If standing orders are extended to your designation and you may also look into notice period as in SE Act.

--“ Company terminated all employee without any notice period”

If company has terminated without leveling any charge/ any reason as a termination simplicitor invoking and referring to some clause in appointment Letter Company is under obligation to tender notice pay as per contractual obligation.

If company has leveled some charge company is under obligation to issue show cause notice, conduct inquiry, and follow principle of natural justice.

Company might have played foul by inserting some documents in personnel file without supplying to employee.

It shall be appropriate to approach consult a competent and experienced labor consultant/service lawyer with copies of al docs and record and give inputs in person and submit a carefully structured representation to good offices of appointing authority, MD, Chairman, Company Secretary and request to allow to examine the personnel file being maintained in its HO and supply correct FNF statement, Form 16, work experience/

Service certificate, reliving letter, PF number, PF a/c slips, etc…..by redg. post.

You may mention that a  postage prepaid { as purchased from PO } self addressed envelope bearing postage stamps of Rs….is enclosed for sending reply and docs by redg. post to you, so as to reach you in next 7 days.
