Neighbour harassment

Dear all,

I need suggestion as to how can i charge my neighbour legally.

We live in a flat which is on rental basis. The flat right above our flat has been purchased by some individual, who has been renovating it since about 6 months. The full basic structure as offered is broken and the disgusting sound of marbles tiles wall break up continues all day till 8pm. My parents have retired and they feel really uncomfortable under the roof. It becomes impossible to even talk to each other, they cant sleep cant watch tv cant talk on phone and above cant even sleep. I agree he can do anything with his property up there but is such renovation which lasts more than 6 months allowed. The amount of dust it generates one cant even prepare food. They have been told regularly about the problem but every month end they say just a month more. All of us in the family are fed up and wish to take legal action. Please suggest.

You cannot do anything.  You inform the owner of the flat and you can take the help of the police .

The same problem is experienced by us us also , now.  In 2014.  And shockingly, even now there is no solution  to this despite of so many flats and complexes that have come up In these years. Now, all cannot reside in the topmost floors. This problem should be addressed.

I'm sure, some of the lawyers themselves must have faced this problem. I see this as a new opportunity to help the common man, especially senior citizens, as we too will be in that category in a few years.

Please guide, if there is anything I can do anything legally to solve this problem of mine. Even the secretary is offering no help. Also, the residents of upper floor are pressuring us to keep our mouth shut about our problems.

Please guide.
