I stay in Raipur, chhattisgarh. We had old home with rooftop of ancient design. And had balcony on the same. We started building house this January, simultaneous our neighbor house is also getting built. As we demolished the old building, they took the advantage and they made their wall just infornt of our boundry wall, where on top we had balcony, to have his wall straight. When we have to built our balcony, he has encroched our 3 ft long and 2 ft breadth of balcony. We politely ask them not do this but they started abusing. Please suggest what legal action to be taken to demolish their adverse possession.
Note: - They dont have original map of their house, if municipality comes for measurement they can see they have captured a lot. they have not paid any property tax, as it not transferred to his name, its in his father's name and (they have 4 brothers). Contrary our house is having name transferred, older map available and property tax paid.
