Need to know about the divorce law

1. Grounds mentioned in annexure are not enough to jump to usage of Hindu Marriage Act.
2. Apart from above you are eligible to file a divorce suit just because marriage is more than one year old that is all. But do re-read para 1 again.
3. Since by your own admission issues are of normal wear and tear nature hence atleast stay neutral i.e. in ‘separated’ yet not divorced legally “way of life”.
4. If para 3 is not possible then set up a nucleus rented place next to parents locality and tell your wife to adjust to your routine of balancing your stay / looking after aged parents and your current family responsibilities. If she agrees then set up a nucleus home for yourself.
5. Unless your wife can be proved to be a bad mother or of bad character at the stated age of the child you have almost nil chance for seeking custody of child leave aside few occasions Court may allow meeting child that also his mother in company just for few hours so advised to follow para 1 r/w para 3 and 4.
6. Experience of other married male victims says that unless one has sound grounds for divorce and child custody it is better to live a life of “harassed husband” and second is by becoming commando by studying Law and come what may come become activities and as party in person contest matrimonial cases an finally if one has enough money to give as alimony then opt for mutual consent divorce with set visitation / custody issues amicably and thus seek divorce amicably (mutual consent divorce is what I mean lastly).
