Is recorded phone call (voice) considered as witness

I have been cheated by a Chartated Account for one lahk rupees, after I realise I have recorded phone call, to have some supporting evidance to show as he has taken one lahk rupees from me. ?

 

Is court accepts my evidance?

If not why? What Type of evidance I need to collect from him.

Dear Sukumar,

 

Lodge an FIR for cheating. A recorded telephonic conversation is admissible as evidence u/s 7 of the Evidence Act if the following essentials are fulfilled.

 

1. The conversation should be relevant to the facts of the case.

2. There should be no possibility of tampering with the recorded conversation.

3. The voice of the speaker should be clearly identifiable.

4. The conversation should be audible and not distorted or damaged by background .
